1. About us and these terms

thyme.tax (the “Site”) is operated by Thyme Tax & Accountancy Ltd (“Thyme”, “we”, “us”), a company registered in Scotland (company number SC772358), with registered office at 36 Angusfield Avenue, Aberdeen, AB15 6AQ. You can contact us at contact@thyme.tax.

These Terms of Use govern your use of the Site. By using the Site you accept these Terms; if you do not accept them, please do not use the Site.

The Site is provided for general information about our firm and services and to let you get in touch, request a quote, and access our client portal. Buying accounting services from us, and your use of the client portal and software, are governed by separate terms: the engagement letter we agree with you, and the terms presented to you within the portal.

2. Our regulatory status

Thyme is a firm of accountants regulated by the Association of Chartered Certified Accountants (ACCA). Where you use account-information or payment-initiation (open banking) features within our software, those regulated services are provided by a third-party provider authorised and regulated by the Financial Conduct Authority, engaged through our software provider, Calceum; we are not an authorised payment institution.

3. Changes

We may update these Terms and the Site at any time. The current version is always on this page; continued use of the Site means you accept any changes.

4. Availability

We aim to keep the Site available but do not guarantee it will be uninterrupted or error-free. We may suspend, withdraw or restrict all or part of the Site for business or operational reasons.

5. Acceptable use

You may use the Site only for lawful purposes. You must not:

• use the Site in any way that breaches any applicable law or regulation;
• misuse the Site by knowingly introducing viruses, trojans, worms or other malicious material;
• attempt to gain unauthorised access to the Site, the server on which it is stored, or any connected server, computer or database; or
• scrape, harvest, data-mine or use automated systems to extract content or data from the Site without our prior written consent.

A breach of this section may be a criminal offence under the Computer Misuse Act 1990; we may report any breach to the relevant authorities and cooperate with them.

6. Intellectual property

We own or are licensed to use all intellectual property rights in the Site and its content (including text, graphics, logos and design). You may view and print extracts for your own use, but you must not copy, reproduce, republish or commercially exploit any content without our prior written permission. “Thyme” and our logos are our trademarks and may not be used without permission.

7. No reliance on information

Content on the Site is for general information only and is not advice. In particular it is not tax, accounting, legal or financial advice, and must not be relied on for any decision. While we take reasonable care, we make no representation or warranty that the content is accurate, complete or current. You should obtain professional advice, or engage us formally, before acting on anything on the Site. See our Disclaimer.

8. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable law. Nothing in these Terms affects your statutory rights as a consumer.

Subject to that, we will not be liable to you for any loss or damage, whether in contract, delict (including negligence), breach of statutory duty or otherwise, arising out of or in connection with use of, or inability to use, the Site or reliance on any content on it, including loss of profits, business, goodwill or data, or any indirect or consequential loss.

9. Viruses

We do not guarantee that the Site will be secure or free from bugs or viruses. You are responsible for configuring your own technology and anti-virus protection to access the Site.

10. Links to other sites

Where the Site links to third-party sites or resources, those links are provided for information only and we have no control over, and accept no responsibility for, their content.

11. Privacy and cookies

We process personal data in accordance with our Privacy Policy, and use cookies in accordance with our Cookie Policy.

12. Governing law

These Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the law of Scotland, and the courts of Scotland have exclusive jurisdiction.
